How long does an employment visa petition take?
Timelines vary a lot by category. Some employment petitions qualify for USCIS premium processing, which can be as fast as 15 business days, while others run several months. We will give you a realistic, category-specific estimate during your consultation.
I want to start or expand a business in the U.S. Is there a visa for that?
Investor pathways such as E-2 and EB-5 exist for people starting or expanding a U.S. business. Whether one fits depends on your plan and your circumstances, which we review together before filing anything.
Can my spouse work if I come to the U.S. on a work visa?
It depends entirely on the category, and the differences are sharp. A spouse of an E-2 treaty investor in valid status is generally considered employment authorized incident to status, with no separate work permit application needed in most cases. An L-2 spouse is treated the same way — employment authorized incident to status, without a separate work permit application. O-3, TD, and R-2 dependents may study but may not work in the United States. H-4 spouses can work only in limited circumstances — generally where the H-1B worker is the principal beneficiary of an approved immigrant worker petition, or has extended H-1B time under specific provisions of federal law — and it requires a separate application. We confirm which rule applies to your family before you plan around one.
Can I sponsor myself through a company I own?
Sometimes, and it depends on the category. An O-1 beneficiary cannot file a petition for themselves personally, but a separate legal entity they own — a corporation or LLC — may file on their behalf, a structure that is expressly permitted and common in founder cases provided the entity is genuinely established. TN status runs the other way: it does not authorize establishing a business or practice in which the professional would be, in substance, self-employed. And an E-2 investor is required to develop and direct the enterprise, which generally means owning at least 50 percent of it or otherwise holding operational control. If you own or control the business, that fact shapes which category is even available, so raise it early.
