On Oct. 14, 2026, DHS published a final rule, “Removal of Automatic Extensions for Certain Employment Authorization Documents,” 91 FR 65306, effective the same day. It adopts, without change, the interim final rule published Oct. 30, 2025 (90 FR 48799): a work permit renewal application filed on or after Oct. 30, 2025 no longer carries an automatic extension of the old card while the renewal is pending.
Extensions that come from a statute or from a Federal Register notice for a specific program, such as a TPS notice, are not affected by this rule. Because the final rule keeps the interim rule as written, nothing changes in practice for renewals already governed by it.
If you rely on a work permit that will expire, check the card’s expiration date and the current USCIS guidance for your category before you file, and ask us about your situation.
